Patient outcome after serious brain injury is highly variable. Following a period of coma, some patients recover while others progress into a vegetative state (unresponsive wakefulness syndrome) or minimally conscious state. In both cases, assessment is difficult and misdiagnosis may be as high as 43%. Recent advances in neuroimaging suggest a solution. Both functional magnetic resonance imaging and electroencephalography have been used to detect residual cognitive function in vegetative and minimally conscious patients. Neuroimaging may improve diagnosis and prognostication. These techniques (...) are beginning to be applied to comatose patients soon after injury. Evidence of preserved cognitive function may predict recovery, and this information would help families and health providers. Complex ethical issues arise due to the vulnerability of patients and families, difficulties interpreting negative results, restriction of communication to “yes” or “no” answers, and cost. We seek to investigate ethical issues in the use of neuroimaging in behaviorally nonresponsive patients who have suffered serious brain injury. The objectives of this research are to: (1) create an approach to capacity assessment using neuroimaging; (2) develop an ethics of welfare framework to guide considerations of quality of life; (3) explore the impact of neuroimaging on families; and, (4) analyze the ethics of the use of neuroimaging in comatose patients. BackgroundSevere brain injury is a leading cause of death and disability. Diagnosis and prognostication are difficult, and errors occur often. Novel neuroimaging methods can improve diagnostic and prognostic accuracy, especially in patients with prolonged disorders of consciousness (PDoC). Yet it is currently unknown how family caregivers understand this information, raising ethical concerns that disclosure of neuroimaging results could result in therapeutic misconception or false hope.MethodsTo examine these ethical concerns, we conducted semi-structured interviews with caregivers of patients with PDoC who were (...) enrolled in a concurrent neuroimaging research program designed to detect covert consciousness following severe brain injury. Caregivers held surrogate decision-making status for a patient. Interviews were conducted at two time points for each caregiver. The first interview occurred before the disclosure of neuroimaging results. The second occurred after disclosure. Descriptive analysis was applied to the data of four interview topics: (1) expectations for neuroimaging; (2) reactions to evidence of preserved cognition; (3) reactions to null results; and (4) understanding of the results and study.ResultsTwelve caregivers participated in the study; two caregivers shared surrogate decision-making status for one patient with PDoC. Twenty-one interviews were completed; one caregiver declined to participate in the post-disclosure interview. Three patients with PDoC associated with the study displayed evidence of covert consciousness. Overall, caregivers understood the neuroimaging research and results. Caregivers who received results of covert consciousness were generally pleased. However, there was some variation in expectations and reactions to these data and null results.ConclusionThis study, for the first time, reveals caregiver expectations for and reactions to neuroimaging evidence of covert consciousness in patients with PDoC. Caregivers understood the neuroimaging research and results, casting doubt on speculative ethical concerns regarding therapeutic misconception and false hope. However, disclosure of neuroimaging result could be improved. Pre-disclosure consultations might assist professionals in shaping caregiver expectations. Standardization of disclosure might also improve comprehension of the results. (shrink)

After severe brain injury, one of the key challenges for medical doctors is to determine the patient’s prognosis. Who will do well? Who will not do well? Physicians need to know this, and families need to do this too, to address choices regarding the continuation of life supporting therapies. However, current prognostication methods are insufficient to provide a reliable prognosis. -/- Functional Magnetic Resonance Imaging (MRI) holds considerable promise for improving the accuracy of prognosis in acute brain injury patients. Nonetheless, (...) research on functional MRI in the intensive care unit context is ethically challenging. These studies raise several ethical issues that have not been addressed so far. Institutional review board delays may hinder the successful completion of federally funded research in the U.S. military. When this happens, time-sensitive, mission-relevant questions go unanswered. Research participants face unnecessary burdens and risks if delays squeeze recruitment timelines, resulting in inadequate sample sizes for definitive analyses. More broadly, military members are exposed to untested or undertested interventions, implemented by well-intentioned leaders who bypass the research process altogether. To illustrate, we offer two case examples. We posit that IRB delays often appear in (...) the service of managing institutional risk, rather than protecting research participants. Regulators may see more risk associated with moving quickly than risk related to delay, choosing to err on the side of bureaucracy. It is argued that a chief obstacle to a naturalistic explanation of the origins of mind is human exceptionalism, as exempli fi ed in the seventeenth century by René Descartes and in the twentieth century by Noam Chomsky. As an antidote to human exceptionalism, we turn to the account of aesthetic judgment in Charles Darwin’s Descent of Man , according to which the mental capacities of humans differ from those of lower animals only in degree, and not in kind. My title is taken from the frontispiece to Ogilby's translation of Aesop ; since every Renaissance poet believed the statement to be true, let me start with my own example. John Denham's only play, The Sophy, published in August 1642, is a tale about the perils of jealousy. The good prince Mirza, after a miraculous victory over the Turks, returns in glory to his father's court, but leaves it shortly thereafter. In his absense, Haly, the evil courtier, follows a friend's (...) advice to " work on [the king's] fears, till fear hath made him cruel"1 and poisons the king's mind with jealousy against his son. Mirza returns only to be brutally blinded and killed, and the emperor soon dies stricken with remorse. Now it happens that Parliament justified all its actions in the months preceding the civil war on the grounds of the "fears and jealousies" that the king had inspired. Charles was incensed by the slogan and claimed angrily that he, if anyone, had the most cause for fears and jealousies.2 Denham obviously decided that here was the all-consuming topic around which a predominantly royalist drama could be written. He followed what I believe was the standard practice - the method that Fulke Greville said Sidney used and that Congreve repeated at the end of the century when he declared of The Double Dealer that "I design'd the Moral first, and to that Moral I invented the Fable."3 He found a plot in Thomas Herbert's Travels into Diverse Parts of Asia that recorded some terrible cruelties and catastrophes caused by jealousy, and he added the point that the emperor's mind had been wrought upon by his counselor. There is no evidence that the play was ever acted, but the most casual reader would have said to himself, "Yes, history reminds us that states destroy themselves through fears and jealousies, and we should abate our own before it is too late." · 1. Although phrases like "distempers and jealousies" had been used earlier, Clarendon on two occasions is quite specific that "fears and jealousies" were "the new words which served to justify all indispositions and to excuse all disorders" in January 1642 . Taken with other evidence, Clarendon's remarks strongly suggest that The Sophy was written after Coopers Hill, and during seven months preceding its publication in August 1642.· 3. Simpson also includes a translation of the last book of the Nicomachean Ethics, which many see as an introduction or transition to the Politics, a brief discussion of the translations of certain key terms, a glossary of significant terms, and an analytical outline of the argument of the Politics. The result is a welcome and useful translation and set of tools.Two of Simpson’s decisions in preparing his translation are regrettable. First, Simpson places the discussion of the best polis in books 7 and 8 between the discussion of the nature of the polis and its kinds in book 3 and the discussion of other sorts of polis in books 4–6, thus printing the books in the order 1, 2, 3, 7, 8, 4, 5, 6. There are good reasons for believing that this is how Aristotle intended the Politics to be read. But in deciding the order in which to print the books, these reasons must be weighed against the inconvenience and confusion produced by departing from the normal, manuscript ordering of the books. In my view this is not even a close call. One can easily indicate one’s belief about the correct order of the books, as Simpson does (xvi–xx), and avoid all inconvenience by printing the books in their manuscript order.More to be regretted is Simpson’s decision (made, I imagine, for aesthetic reasons) not to follow the increasingly common and laudable practice of printing Bekker numbers in the margins of translations of Aristotle. These numbers are a great convenience to readers, for they make it easy to locate specific passages in different translations and in the Greek original. After a legendary teaching career spanning nearly fifty years, thirty-four at Pomona College and another fifteen at the California Institute of Technology, (...) Will retired in 1985. He published a host of articles and books, among them the highly regarded five-volume A History of Western Philosophy, now in its fourth edition. Will received numerous awards and honors, including Lippincott, Procter, Ford Faculty, and Guggenheim Fellowships; he was also a Phi Beta Kappa Visiting Scholar, and twice a Resident Scholar with the Rockefeller Foundation at Villa Servelloni. In 1969–70, he was President of the American Philosophical Association’s Pacific Division.In 1961, Will joined Karl Aschenbrenner, John D. Goheen, Paul O. Kristeller, Oskar Piest, Benson Mates, Ernest Moody, Richard H. Popkin, Herbert W. Schneider, and E. W. To these ends, Trevor Saunders’s welcome addition to the series, a treatment of the first two books of Aristotle’s Politics, provides a number of useful tools. First there is a new translation of books I and II. Saunders numbers the paragraphs of the translation and the corresponding sections (...) of the commentary to facilitate reference to the text and commentary within the discussion of each chapter, though not across chapters. Saunders provides Greek-English and English-Greek glossaries. These will be especially useful to Greek-less readers, because Saunders is often traditional in his translation of key terms and thus, for example, obscures connections that have to be made explicit. So, for example, Saunders follows the very common practice of rendering the cognates polis, politês, and politeia as ‘state’, ‘citizen’, and ‘constitution’, respectively. Each section of the commentary begins with an introduction and proceeds to discuss each paragraph in turn, often including several recommendations for where to go next in the secondary literature. The book also has a guide to the translation and commentary, a brief but helpful introduction, a short appendix on the alleged oligarchic bias in Plato’s Laws, a list of departures from Ross’s Oxford Classical Text, a bibliography of works cited, and a selective index. You might do this for any of a number of reasons: (...) because you want to place me in your debt, because you want to impress bystanders, etc. But you might also do it for none of these reasons. You might do it, instead, because, understanding what resources are and what resources are for, you see taking me to the airport as an appropriate use of your resources (your time and your car), given our relationship and the circumstances in which we find ourselves.That's the Readers' Digest version of one story one might tell, on Aristotle's behalf, by way of connecting up friendship, virtuous action, practical and theoretical wisdom, action for its own sake, and action for the sake of the fine in the Nicomachean Ethics. I myself think it is a good story. It is also a story, I think, that Gabriel Richardson Lear tells, at least some of the time, in Happy Lives and the Highest Good, though she tells it with respect to courage, temperance, and magnanimity, not liberality and friendship.Most of the time, however, Lear tells another story. According to it, your taking me to the airport makes clear your commitment to make use of your resources to promote my good. Since we are friends, however, my good is bound up with yours, so in promoting my good you also promote your own good. But according to Aristotle the good for each of us is a life in which rationality is realized in thought and action. Hence your taking me to the airport counts as fine because it shows your commitment to that sort of life. But, again according to Aristotle, the centerpiece, and source of value, of that sort of life is contemplative activity, so you act for the sake of contemplation, whether you know this or not. And, in view of its expression of practical reason and truthfulness, your liberal activity is structurally similar to and so approximates to contemplative activity, and this allows us to say that you did what you did for the sake of contemplation.This is, so far as I know, an entirely new approach to the problems raised by Aristotle's identification of happiness with contemplation in NE X. Lear's story, and the arguments in its support, deserve and will repay serious attention. I limit myself here to four concerns about some of the details.First, our first story locates what is fine about virtuous action in the fit exhibited among the agent, her action, and her situation. Lear's story locates what is fine about virtuous action in its promotion of a certain kind of life. The first story thus sees what is fine about [End Page 118] virtuous action as something intrinsic to it, while Lear's story sees it as something external to it that it promotes. The first story seems to me to be looking in the right place.Second, the first story has it that virtuous activity is an expression of understanding, Lear's story that it is an expression of a commitment to understanding. Again, the first story seems to me to be looking in the right place.Third, Lear thinks that the liberal person can be said to act for the sake of contemplation when contemplation is the source of value for what she does, even when it is not the conscious aspiration of her action. That may be true, but I do not see that it is enough. What needs explanation is rather that she can be said to choose liberal activity for the sake of contemplation, and it is unclear how this could be unconscious.Finally, Lear's appeal to approximation may prove too much. YoungWilliam Thomas Jones, a friend and supporter of this journal since its inception, died on September 30, 1998, in Claremont, California, at the age of eighty-eight. Born in Natchez, Mississippi, Will was educated at Swarthmore, Oxford (as a Rhodes scholar), and Princeton. After a legendary teaching career spanning nearly fifty years, thirty-four at Pomona College and another fifteen at the California Institute of Technology, (...) Will retired in 1985. He published a host of articles and books, among them the highly regarded five-volume A History of Western Philosophy, now in its fourth edition. Will received numerous awards and honors, including Lippincott, Procter, Ford Faculty, and Guggenheim Fellowships; he was also a Phi Beta Kappa Visiting Scholar, and twice a Resident Scholar with the Rockefeller Foundation at Villa Servelloni. In 1969–70, he was President of the American Philosophical Association’s Pacific Division.In 1961, Will joined Karl Aschenbrenner, John D. Goheen, Paul O. Kristeller, Oskar Piest, Benson Mates, Ernest Moody, Richard H. Popkin, Herbert W. Schneider, and E. W. Strong (as chair) to form the Executive Committee (now Board of Directors) of the Journal of the History of Philosophy. The first issue of the JHP appeared some two years later. Will provided much valuable counsel and support in the turbulent early years of the JHP, helping in particular in securing much needed financial support from the Claremont Colleges. A growing phenomenon in contemporary society is adult children caring for their elderly parents. Although some interest has been directed to the question of filial piety in general, surprisingly, scant attention has been focused on the ethical dimensions of caring for elderly parents. This article explores the contribution that Aquinas’s theory of the virtues of filial piety and prudence can make to the ethical dilemmas of elder care. In examining Aquinas’s theory, I explicate the relationship between moral agency and prudence, (...) with a special emphasis on the relationship between the integral parts of prudence and the exercise of moral virtue. In doing so, I suggest how Aquinas’s theory can shape and guide contemporary filial piety in order to advance quality elder care. (shrink)
